These Terms of Service ("Terms") govern your access to and use of the online auction platform operated by Betterfli, LLC ("Auction Broadcaster", "we", "us", or "our"), including bidder registration, browsing the catalog, and participating in live or timed auctions (collectively, the "Services"). By registering for an account, placing a bid, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility & Account Registration

To bid, you must register for an account and be at least 18 years of age (or the age of majority in your jurisdiction) and able to form a legally binding contract. You agree to provide accurate, current, and complete information during registration and to keep it up to date. Registrations may be subject to review and approval, and we (or the relevant auction house) may decline, suspend, or revoke bidding privileges at our discretion.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.

The final purchase price for a won lot ("hammer price") is subject to a buyer's premium — an additional percentage of the hammer price — as disclosed for the applicable auction. You are also responsible for all applicable sales, use, VAT, or other taxes, as well as any shipping, handling, insurance, and processing fees. The total amount due will be reflected in the invoice issued to you.

Unless otherwise arranged, you are responsible for arranging and paying for collection or shipping of won lots within the timeframe specified. Uncollected lots may be subject to storage fees or be treated as abandoned in accordance with applicable law.

All lots are sold "AS IS" and "WHERE IS," with all faults. Catalog descriptions, images, estimates, condition reports, and other statements are provided for guidance only and are opinions, not statements of fact or warranties. To the fullest extent permitted by law, we make no representations or warranties of any kind, express or implied, including as to merchantability, fitness for a particular purpose, authenticity, provenance, attribution, condition, or description. Prospective bidders are responsible for inspecting lots and satisfying themselves as to their condition before bidding.

If a dispute arises regarding a bid, sale, or lot, you agree to first contact us in good faith to seek an informal resolution. We may, acting reasonably, make final determinations regarding the conduct of an auction, including the identity of the winning bidder and whether to void a bid or sale. Any dispute that cannot be resolved informally shall be handled in accordance with the governing law set out below.

To the fullest extent permitted by law, in no event shall Betterfli, LLC, its affiliates, or their respective officers, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or in connection with your use of the Services or the purchase of any lot. Our aggregate liability for any claim relating to a lot shall not exceed the amount you actually paid for that lot.

We may suspend or terminate your account and access to the Services at any time, with or without notice, for any conduct that we believe violates these Terms or is otherwise harmful to other users, the platform, or third parties. You may stop using the Services at any time. Provisions that by their nature should survive termination (including payment obligations, disclaimers, and limitations of liability) shall survive.

We may update these Terms from time to time. Changes become effective when posted, and your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.

12. Governing Law

These Terms and any dispute arising out of or relating to them or the Services shall be governed by and construed in accordance with the laws of New Mexico, without regard to its conflict-of-laws principles.
